Terms of Service

1. Agreement to Terms

By accessing or using Linespire Reflect ("we," "us," "service," or "our"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

2. The Service & AI Nature

Linespire Reflect is an AI-assisted visualization tool for Archicad.

• Conceptual Visualization: You acknowledge that the Service uses Generative AI (Google Gemini). All outputs are conceptual visualizations only.
• No Professional Advice: The images produced are not architectural drawings, engineering plans, or construction documents. They must not be used for structural, safety, or regulatory compliance.
• Accuracy: AI can "hallucinate" or misinterpret architectural geometry. We do not guarantee the accuracy, scale, or buildability of any generated image.

3. User Obligations & Professional Responsibility

• Final Review: You are solely responsible for reviewing any AI-generated content before sharing it with clients or authorities.
• No Reliance: You agree that you will not rely on the Service for any decision that could result in financial loss, physical injury, or property damage.
• Account Security: You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Fees, Credits, and Subscriptions

• Pricing: Credits and subscriptions are billed via Stripe. All prices are in USD and exclude GST unless otherwise stated.
• Credit Expiry: Free trial credits may expire at our discretion. Paid credits are valid for the duration of an active subscription.
• Refunds: To the extent permitted by the Australian Consumer Law, payments are non-refundable. If the Service is unavailable due to a major failure, you may be entitled to a remedy under the ACL.

5. Intellectual Property & AI Data Handling

• Ownership: Linespire Reflect claims no ownership over the original architectural views or prompts you upload ("Inputs"), nor the resulting AI-generated images ("Outputs"). You maintain all rights to your original designs.
• AI Third-Party Referral: You acknowledge that all rendering is performed by third-party AI models (Google Vertex AI). Your use of the Service is an explicit instruction for us to transmit your data to Google for processing.
• No Guarantee of Third-Party Conduct: We do not use your data to train proprietary models. However, we have no control over, and assume no responsibility for, the data-handling practices or future policy changes of Google as the third-party provider.
• Third-Party Liability Disclaimer: To the maximum extent permitted by law, we are not liable for any data breach, privacy violation, or unauthorized usage of your data that occurs within Google’s infrastructure or as a result of Google’s processing logic. Users use the service at their own risk regarding third-party data handling.

6. Limitation of Liability

• Total Cap: To the maximum extent permitted by law, our total liability to you for any claim arising out of these Terms or the Service is limited to the total amount paid by you to us in the 12 months preceding the claim.
• Indirect Loss: We are not liable for any loss of profit, loss of data, loss of business opportunity, or any consequential or indirect damages.

7. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or legal fees arising from:

• Your breach of these Terms.
• Your use of an AI-generated image to mislead a third party.
• Any structural or construction failure resulting from your reliance on the Service.

8. Third-Party Dependencies & AI Processing Risks

The Service relies on third-party providers (Google Cloud, Supabase, Stripe, Resend). We are not liable for any service interruptions, data loss, or "API outages" caused by these providers. By using the Service, you acknowledge that because data is processed by these third parties, we cannot guarantee their future policy changes, and you use the Service at your own risk regarding third-party data handling.

9. Governing Law

These Terms are governed by the laws of Australia. You submit to the exclusive jurisdiction of the courts in that country.
